         Kathleen Mahan's pre-law background is in real estate sales/investment, title and escrow.  Ms. Mahan began her practice in Santa Barbara, California in 1987. Ms. Mahan interned with the District Attorney's office for a year and clerked for a civil litigator during law school.  Ms. Mahan then joined a boutique firm, which represented real estate developers.  In 1988, Ms. Mahan began her own practice, devoted almost exclusively to real property law, both transactional and in the courts. 
          In the area of environmental law, Ms. Mahan has  handled numerous hazardous materials cases, including lead, asbestos, mold and toxic contamination of soils and water tables by dichloroethylene and other toxic chemicals. 
           In the area of real estate development, she has prepared various easements, Homeowners' Association Bylaws, CC&R's  and obtained land use permits for raw land.  In the area of zoning and land use, she has obtained land use permits for "as built" structures and zoning compliance for  non-conforming structures, as well as facilitating building permits for contractors and homeowners, to correct building code violations.
           In the area of Construction Law, Ms. Mahan has represented both contractors and homeowners, regarding defective construction, contracts and mechanic's lien law issues.   
            Ms. Mahan's extensive transactional real property law experience also includes boundary line agreements, licenses, easements, sales contracts, exchanges and commercial leases.  Her extensive litigation experience includes, among other actions, seller disclosure issues, breach of contract,  misrepresentation, quiet title actions and construction issues.
           Ms. Mahan's twenty-three year practice overlaps the areas of estate planning and business law, including creating business entities  and estate documents for title and vesting purposes. 
           After 30 years of regularly visiting friends and family on the Monterey Peninsula, Ms. Mahan and her teenage son, Collin have made this area their home. 
      Since the fall of the real estate market in 2007, Ms. Mahan has litigated extensively against bad faith and unlawful actions by lenders, in order to preserve homeowner's rights and assist with rebuilding the real estate market.
          Ms. Mahan is a member of the Real Property Law section of the State Bar and a member of the Monterey County Bar.  She is a supporter of  several musical affiliations, assists various local charities, pro bono.
